What is 'Design & Construction' (Dc) or 'Design & Build'?

A type of construction contract where the contractor takes on responsibility for providing professional activities in addition to their usual contracting duties.

What are professional activities?

The performance of:
  • Design or specification
  • Supervision of construction
  • Feasibility study including application for planning consent
  • Planning supervisory services
  • Estimation of construction costs
Normally undertaken by professional consultants such as surveyors, architects or engineers D&C has become an increasingly popular form of construction procurement, and incorporates contracts covering a range of different construction sectors, including:
  • Private housing
  • Public housing
  • Other public construction
  • Utilities
  • Private industrial
  • Private commercial
  • Refurbishment

Acceptable qualifications

Cover for D&C only relates to those individuals undertaking Professional Activities and it is important that the contractor's consultants (whether directly employed or sub-contracted) have suitable qualifications to undertake such work.

MICE - Institution of Civil Engineers
MIStructE - Institution of Structural Engineers
FRIBA/ARIBA - Royal Institute of British Architects
ASI - Architects and Surveyors Institute (Formerly FIAA/AIAA Incorporated Association of Architects & Surveyors)
FFAS/AFAS - Faculty of Architects & Surveyors
MBIAT - British Institute of Architectural Technicians
FRTP/MRTPI - Royal Town Planning Institute

Unacceptable risks

  • Any risk with an office or representation based outside the UK
  • Firms established less than 5 years
  • Any risk where turnover less than £75,000
  • Any risk where income derived from overseas clients exceeds 25% of total fee income

Limits

Up to £5 million in the aggregate inclusive of costs

Excess

£1,000 excess each and every claim
